EarnCommand OS Terms of Service

Agreement

These Terms of Service are an agreement between you and Baruch Holdings LLC ("Baruch Holdings," "we," "us," or "our"), the seller and operator of EarnCommand OS. By creating an account, purchasing a subscription, or continuing to access or use the service, you agree to these terms.

If you use EarnCommand OS for an organization, you confirm that you have authority to bind that organization. You must be legally able to enter into this agreement.

Eligibility

The service is intended for adults and others who can lawfully enter into a binding contract and use business decision-support software in their jurisdiction.

Account Responsibilities

You must provide accurate information, keep it current, protect your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account except where applicable law provides otherwise.

Acceptable Use

You may not use the service for unlawful activity, fraud, spam, harassment, hate or abusive content, intellectual-property infringement, deceptive impersonation or deepfakes, malware, security probing, unauthorized scraping, circumvention of technical limits, reverse engineering, resale, or attempts to disrupt the service or gain unauthorized access.

You must not use AI features to create illegal or harmful content, evade safeguards, or present generated output as verified fact when it has not been checked. We may refuse or filter outputs and remove or restrict content when reasonably necessary for safety, legal compliance, or enforcement of these terms.

Subscriptions

Paid features are offered under the plan, price, billing frequency, and usage limits displayed at checkout. Subscriptions renew for the period shown at checkout until cancelled.

You may cancel through the available billing controls. Cancellation normally takes effect at the end of the current paid billing period, subject to Paddle's Buyer Terms and applicable law.

Trial

Where a trial is offered, its duration and included features are shown when you start it. Unless the checkout or trial offer states otherwise, access to paid features ends when the trial expires unless you begin a paid subscription.

Payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, applicable taxes, renewal, cancellation, and refund mechanics are governed by the plan shown at checkout, our Refund Policy, and Paddle's Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms.

Cancellation

You may cancel a paid subscription through the billing controls made available by Paddle or through Paddle support. Cancellation stops future renewals and does not automatically create a refund; eligible refunds are handled under our Refund Policy and applicable law.

After cancellation, paid access ordinarily continues through the end of the paid billing period. We may retain or delete account data as described in our Privacy Notice.

AI Features

AI features provide decision support, drafting, summarization, prioritization, and reasoning assistance. You are responsible for your prompts, your use of outputs, verifying accuracy, and ensuring that you have the rights and permissions needed for any content you submit.

AI output may be incomplete, inaccurate, or unsuitable for your circumstances. It is not professional legal, accounting, tax, investment, financial, medical, or regulatory advice and must not be relied on for regulated or high-impact decisions without qualified human oversight.

User Content

You retain ownership of content you submit and, as between you and Baruch Holdings LLC, output generated for you to the extent permitted by law. You grant us a limited, worldwide license to host, process, reproduce, and transmit your content solely to operate, secure, and improve the service.

You represent that you have the rights needed to submit your content. Rights holders may report alleged infringement through our contact page. We may remove disputed material and suspend repeat infringers where appropriate.

Intellectual Property

Baruch Holdings LLC and its licensors retain all rights in EarnCommand OS, including its software, documentation, branding, designs, and other service materials. Your subscription grants only a limited, non-exclusive, non-transferable right to use the service during your authorized access period.

Third-Party Services

Integrations may require separate third-party accounts, fees, permissions, data sharing, and provider terms. We are not responsible for third-party services and may change or discontinue an integration if its provider changes or withdraws access.

No Earnings Guarantee

EarnCommand is a decision-support and operating platform. It does not guarantee revenue, profit, customers, funding, rankings, demand, or business outcomes.

Disclaimers

To the fullest extent permitted by law, the service is provided "as is" and "as available" without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, secure, or error-free operation. Public examples are illustrative unless identified as verified results.

Limitation of Liability

To the fullest extent permitted by law, Baruch Holdings LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our aggregate liability arising from the service will not exceed the amount you paid for the service during the 12 months before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, death, or personal injury caused by negligence where applicable.

Termination

We may suspend or terminate access for a material breach of these terms, non-payment, suspected fraud or security risk, legal requirements, or repeated or serious policy violations. Where practical, we will provide notice and an opportunity to remedy the issue.

When access ends, your right to use the service ends. Account data is handled under our Privacy Notice, including applicable retention requirements.

Changes

We may update these terms to reflect changes to the service, law, or business practices. We will post the revised terms and update the date above. We will provide reasonable notice of material changes where required, and continued use after the effective date constitutes acceptance.

Applicable Law

These terms are governed by the laws applicable to Baruch Holdings LLC, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply. Courts with lawful jurisdiction may hear disputes that cannot be resolved informally.
