Cookie & Similar Technologies Notice
EC-LGL-2026-10-14 | Version date: October 14, 2026
Version and application
For a new customer, the contractual terms in this version take effect when Baruch Holdings LLC has published or supplied this version and the customer validly accepts it. For an existing customer, they take effect on the date communicated in the required change notice, subject to any required affirmative acceptance and the protections in Terms of Service Section 29. The version date above is not a representation of an earlier publication or acceptance.
Privacy and technology notices apply to the processing they describe when they are supplied or published as the applicable notices. They do not turn acknowledgment into consent, authorize processing before required disclosures or safeguards exist, or extinguish rights concerning earlier conduct. No charge, renewal authorization, signature, provider approval, or transfer instrument is created merely by generating or receiving this file.
Parts A–K contain the public agreements and notices. Part L and Annexes A–E contain the Data Processing Addendum. Provider-specific disclosures and any required transfer instruments must be supplied and validly authorized for the affected processing as those provisions require. They are not replaced by a generic provider category. Separate reseller agreements and mandatory legal rights remain unaffected.
1. Scope
This notice concerns cookies, local storage, pixels, device identifiers, and comparable technologies used with EarnCommand OS. It also identifies related controls for optional tracking. Actual purpose and operation determine the treatment of a technology.
2. Necessary operations and preferences
Technologies genuinely necessary for a requested service may support authentication, session continuity, security, and recording essential choices. They are not used as a disguised basis for advertising or unrelated tracking. Some preferences are optional rather than necessary.
Blocking necessary storage may prevent login or other requested features. Some identifiers are session-based and others may persist; this notice does not assign an unverified lifetime to a particular identifier. The collection or technology disclosure for the affected feature must state the actual duration or a meaningful expiry criterion before the technology is used where that information is required.
3. Optional technologies and choices
Where optional analytics, experience measurement, or comparable storage is used, the consent or other legally permitted mechanism appropriate to the jurisdiction must apply before the technology operates. Exemptions may still require notice and an objection mechanism. Advertising technologies are not treated as strictly necessary merely because they fund a service.
Where a consent control is shown, you may reject optional categories as readily as accepting them and change the choice later. Continued browsing is not treated as required affirmative consent. A refusal does not prevent standard account registration or purchase. Refresh a page if needed after changing a preference; further unauthorized collection is not permitted.
4. Third-party content and checkout
External embeds, integrations, and checkout can involve a third party’s technology. The applicable technology disclosure and third-party notice must identify the operator and purpose before any required choice is made. Optional third-party content must not start tracking before legally required permission.
Paddle operates its purchase functions under its own notices. The use of a reseller does not excuse our responsibility for technologies we place on our own pages.
5. Technology information and assistance
For each active technology, or a materially accurate group performing the same function, the applicable disclosure must identify its name or group, operator, purpose, information involved, first- or third-party status, relevant page or feature, expiry or retention, and consent or exemption treatment. Applicable server-side tracking must also be disclosed; using a server instead of a browser does not remove privacy obligations.
This notice supplies the governing categories and choice rules, not a verified technology-by-technology inventory. It does not claim that a particular cookie name, provider, or lifespan has been tested. We must supply the actual technology disclosures before relying on consent or an exception that requires them. Optional tracking must remain inactive until the required disclosure and choice mechanism are in place.
You may also adjust browser storage settings. Clearing storage or changing browsers may require renewing privacy choices. Where legally required, applicable opt-out preference signals are honored. Contact baruchstk@gmail.com to ask about a technology or report a preference that is not respected.
You may request the technology information relevant to a page or report an undisclosed technology through the contact channel above. A supplemental technology disclosure forms part of this notice only when it identifies the actual operation; it cannot silently broaden consent or override a recorded refusal.
