Version and application
For a new customer, the contractual terms in this version take effect when Baruch Holdings LLC has published or supplied this version and the customer validly accepts it. For an existing customer, they take effect on the date communicated in the required change notice, subject to any required affirmative acceptance and the protections in Terms of Service Section 29. The version date above is not a representation of an earlier publication or acceptance.
Privacy and technology notices apply to the processing they describe when they are supplied or published as the applicable notices. They do not turn acknowledgment into consent, authorize processing before required disclosures or safeguards exist, or extinguish rights concerning earlier conduct. No charge, renewal authorization, signature, provider approval, or transfer instrument is created merely by generating or receiving this file.
Parts A–K contain the public agreements and notices. Part L and Annexes A–E contain the Data Processing Addendum. Provider-specific disclosures and any required transfer instruments must be supplied and validly authorized for the affected processing as those provisions require. They are not replaced by a generic provider category. Separate reseller agreements and mandatory legal rights remain unaffected.

EarnCommand OS is business-planning and organization software operated by Baruch Holdings LLC. It supports business-idea comparison, planning, projects, customer records, and user-entered financial information. Income DNA uses rules-based matching; Copilot and designated planning or research features use third-party AI.
A subscription provides the software features in the selected plan—not a business, franchise, investment, customers, employment, guaranteed income, or professional engagement. Expert purchases, third-party marketplace transactions, acquisitions, customer or lead placement, and autonomous external actions are excluded from the subscription governed by these Terms.
Agreements and notices
The Terms of Service govern eligibility, accounts, permitted use, subscriptions, ownership, remedies, and disputes. The Refund & Cancellation Policy explains the no-card trial, recurring payments, cancellation, and 30-day guarantee.
The Privacy Notice and Privacy Choices & Requests explain data handling and request channels. The Cookie & Similar Technologies Notice governs storage and tracking disclosures and choices. Provider Disclosures identify recipients for the affected processing. Part L contains the Data Processing Addendum for covered customer-controlled personal data, including the conditions for authorizing providers and international transfers.
The Earnings & Business Results Disclaimer distinguishes estimates from results. The AI & Automated Systems Disclaimer explains AI limitations and human review. Acceptable Use & Community Rules and the Integration & External-Action Notice govern the corresponding available features. Intellectual-property, safety, security, and accessibility contact information appears in the supporting notices.
Important distinctions
Personal Fit is a compatibility result, not a success probability. A forecast remains a forecast even when it uses historical inputs. User-entered or reconciled figures are not independently audited merely because the software displays them. Fictional examples are not customer testimonials.
Eligible export tools identify the information and formats they cover; they do not promise a complete application copy or every internal record. Contact us for access requests or export assistance. Private workspace information is not published merely because an account exists or its owner joins a community.
